Experts Say: "Napster Appears Doomed"

NewsBytes (April 11, 2001) - Given the threat Tuesday by a judge to both shut down Napster and to open the door to a potentially massive class-action lawsuit by songwriters and publishers, several legal and industry experts polled by Newsbytes today formed a consensus: Napster is doomed. 

US District Judge Marilyn Hall Patel stopped short of taking direct action against Napster during Tuesday's compliance hearing, and she appointed a mediator to help negotiate a settlement. 

However, she also said it was "disgraceful" that Napster's efforts to block copyrighted songs from its system have thus far largely failed, and she directly threatened to shut down the song-swapping service. She also said it is likely that a "limited" class-action lawsuit filed by thousands of publishers and songwriters could proceed against the rogue song-swapping service.

Fans have worked around the blocks, often by slightly altering the spelling of band names and song titles so that they slip through the filters' cracks. And many copyrighted songs are available to users without any alterations in their titles.

 And the court battle goes on as the court appointed mediator tries to help negotiate a settlement.
